Two Chinese provinces are trying to deter companies from laying off large numbers of workers as they struggle to limit the fallout from the global financial crisis.
One of the country’s richest and most developed provinces, Shandong, is attempting to enforce a local order that a company must go through the government if it wants to lay off more than 40 employees, an official said yesterday.
“In practice, this order wasn’t very much reinforced. Now we are reaffirming its validity in response to the global financial crisis,” said Wang Kexing, associate researcher of unemployment and social insurance at the Shandong Social Security Department.
The order was issued in 2004 but was not obeyed, he said.
China’s labor contract law, which came into effect in January, says companies must inform employees, labor unions and then labor authorities if they want to lay off more than 20 people, or if they want to lay off more than 10 percent or their labor force. The law is subject to local enforcement.
Shandong, which boasts the port city of Qingdao, is an important hub for exporters and a base for South Korean and Japanese investors.
China’s economic growth fell to 9 percent in the latest quarter after expanding 11.9 percent last year. Exporters say foreign customers are canceling orders, which has led to layoffs and factory closures.
The China Daily newspaper reported that more than 7,000 companies in Guangdong Province, China’s manufacturing hub, closed down or moved elsewhere in the first nine months of the year.
The government earlier this month approved a stimulus package worth 4 trillion yuan (US$586 billion) over the next two years, to inject money into the economy with extra spending on airports, highways and other construction. But the central bank warned yesterday that the country still faces an increased risk of an economic downturn.
Hubei Province has also introduced a program to reduce layoffs, Xinhua news agency reported yesterday. It said state-owned companies must cut salaries before laying off employees and tell the government 30 days in advance if they intend to lay off more than 10 percent of their workforce, or more than 50 workers.
A man surnamed Li with the Hubei branch of the China Council for the Promotion of International Trade said the change would not have a big impact on export companies. Many companies will have their employees take unpaid leave rather than fire them, and oil, finance and power companies are more likely to cut salaries rather than layoff workers, he said.
“Few of them would lay off workers as it involves labor disputes,” said Li, who like many Chinese officials would give only his surname.
The proposed limits come as China suspends a move to raise minimum wages. The Ministry of Human Resources and Social Security announced the freeze on Monday in a notice on its Web site but did not give other details.
The ministry also asked state companies to refrain from laying off employees.

Seven hundred and sixty-four foreigners were arrested last year for acting as money mules for criminals, with many entering Taiwan on a tourist visa for all-expenses-paid trips, the Criminal Investigation Bureau (CIB) said on Saturday.
